Terms of service
The Foundation, LATVIJAS DABAS FONDS, registration No 40008019379, address Blaumaņa iela 32-8, Rīga, LV-1011, hereinafter - the Online Shop - provides the content available on the website and sells goods in accordance with the Terms of Use set out below.
1. General Terms
If the consumer purchases goods through the website, such mutual agreement shall be deemed a Distance Contract and shall be subject to the provisions of the laws of the Republic of Latvia regulating distance contracts, including but not limited to the "Consumer Rights Protection Law" of the Republic of Latvia, the Cabinet of Ministers of the Republic of Latvia "Regulations on Distance Contract", etc.
2. Making purchases
The prices and specifications of the products sold in the online shop are indicated next to the products.
To place an order, add the desired products to your shopping basket. Fill in all the required fields and choose the most suitable delivery method. The total cost of the order including delivery is then displayed on the screen. Checkout to complete your order.
3. Payment terms
The payment currency on the website is the euro. You can pay for your purchase by selecting the following payment methods provided by the payment platform makecommerce.lv, Maksekeskus AS:
- Latvian Internet banking payments
- Visa/Mastercard card payments
- Apple Pay/Google Pay
NB: If you are using an online banking payment method, confirm your order and click on the "Back to merchant" button.
The personal data required for payment is transferred to the licensed payment institution Maksekeskus AS.
The Agreement shall become effective upon successful payment to the online shop's bank account. If for any reason the order cannot be fulfilled, the Buyer will be notified and the amount paid will be refunded as soon as possible, but no later than 14 days after notification.
4. Delivery Terms
The goods are currently delivered within the territory of Latvia. The purchased goods are delivered via Omniva's network of parcel machines or can be collected at the Latvian Fund for Nature's office, Blaumaņa iela 32-8, Riga. Shipping costs are displayed before the order is confirmed. Shipping costs, including any taxes payable to receive the shipment at the delivery destination, shall be borne by the Buyer. Purchased goods are delivered to the address indicated by the Buyer within 7 - 10 working days. In exceptional circumstances, we have the right to dispatch goods up to 45 calendar days, upon notice to the customer.
5. Right of withdrawal
The Buyer has the right to withdraw from the Goods within 14 calendar days after receiving of the Goods. The right of withdrawal shall not apply if the Buyer is a legal person. In the case of a donation, the right of withdrawal shall not apply.
In order to exercise the 14-day right of withdrawal, the goods may only be used for the purposes for which they were intended and the consumer is responsible for maintaining the quality and safety of the goods during the period of exercise of the right of withdrawal. If the goods are inappropriately used or damaged, if they are handled carelessly during use or without following the instructions, if the original packaging of the goods is lost or if the packaging is substantially damaged , the online shop shall be entitled to reduce the amount to be refunded in accordance with the reduction in the value of the goods.
Delivery (shipping) costs are not refunded.
To exercise your right of withdrawal, you must send an email to veikals@ldf.lv within 14 days after receiving of the goods.
To return the Goods we need proof of purchase from the online shop, proof of bank payment.
The Buyer is liable for the costs of returning the goods, except where the reason for the return is that the goods are not as ordered (e.g. incorrect or defective product).
The Buyer is obliged to return the Goods to the Seller without delay, but no later than 14 days after sending the cancellation e-mail to the online shop. Upon receipt of the returned Goods, the Online Shop shall immediately, but no later than within 14 days, refund all payments received from the Buyer on the basis of the Distance Contract.
The Seller shall be entitled to withhold payment until it has received from the Buyer the Goods or proof of return.
The Online Shop shall not be liable for any delay in performance or failure to perform or any other failure to perform caused by circumstances and obstacles beyond the Online Shop's reasonable control.
6. Consumer's rights in respect of non-contractual goods
The Online Shop shall not be liable for any defects arising after delivery of the goods to the Customer. If the goods purchased are defective for which the Seller is liable, the Buyer has the right to have the defective goods repaired or exchanged for new goods free of charge.
If the goods cannot be repaired or replaced, the Seller shall return to the Buyer all payments due under the Distance Contract. The Seller shall reply to the Consumer's complaint in writing within 15 days.
7. Processing of the Buyer's personal data
The online shop processes only the personal data entered by the buyer when ordering goods, such as name, surname, e-mail, mobile phone, e-mail address, phone number, etc. phone number, etc. The online shop passes on personal data to the transport service provider(s) in order to ensure delivery of the goods.
If you have expressly agreed to receive our marketing communications, including newsletters, we may contact you from time to time with information about our services and latest offers. For this purpose, we may process the email address you provided when you signed up for marketing communications.
The Customer has the option to opt-out of marketing communications by notifying us at veikals@ldf.lv
8. Dispute resolution
In matters not covered by these terms and conditions, the Buyer and the Seller agree to comply with the laws and regulations in force in the Republic of Latvia.
The Parties shall resolve any disputes arising between the Seller and the Buyer by means of mutual negotiations or correspondence. If the dispute cannot be resolved by negotiation or correspondence, the Parties shall settle the dispute in the courts of the Republic of Latvia in accordance with the laws and regulations of the Republic of Latvia. Disputes between the Buyer (consumer) and the Seller may be referred to the Consumer Rights Protection Centre or to a court of the Republic of Latvia.
The Buyer shall also have the right to apply to the dispute settlement bodies of the European Union.
